DATA PROTECTION INFORMATION OBLIGATIONSH
 
I.              PERSONAL DATA ADMINISTRATOR
                Tares Sp. z o.o. 121 Tworzeń Street, 41-303 Dąbrowa Górnicza.

II. PROCESSED PERSONAL DATA We process personal data in connection with: 1. PROVISION OF LONGITUDINAL AND TRANSVERSE SHEET METAL CUTTING SERVICES, SALE OF METALLURGICAL PRODUCTS, SHEET METAL ROOFING AND RELATED ACCESSORIES We are a distributor of steel products and a steel service centre, we cooperate with other manufacturers or distributors. Data subjects: contractors, potential contractors, as well as their employees and persons working with them. Data processed: first names, surnames, business data, contact data, address data, bank account numbers, registration and registration data (e.g.: PESEL). If the sale takes place with transport additionally the registration numbers, the identity card or passport number of the driver, as well as the driver’s driving licence number.
Basis and purposes of data processing:
1) conclusion and performance of the contract;
2. performance of existing legal obligations, e.g:
a. storage of data for future proceedings of authorised authorities;
b. filing and processing of complaints;
c. settlement of public law contributions;
3. legitimate legal interest:
a. To document the performance of a transaction;
b. establishing, defending and asserting claims;
c. direct marketing;
d. to compile compilations, analyses and statistics, including turnover and sales, for internal purposes;
e. verification of the counterparty’s payment reliability;
f. archiving.
2. TRANSPORT SERVICES TO CUSTOMERS AND SUPPLIERS
Handling and verification of transport services. Data subjects: contractors, potential contractors, as well as their employees and persons working with them. Data processed: name of the person, business data, contact data, address data, bank account numbers, registration and record data, as well as registration numbers, driver’s identity card or passport number, and driver’s driving licence number.
Basis and purposes of data processing:
1) conclusion and performance of the contract;
2. performance of existing legal obligations, e.g:
a. storage of data for future proceedings of authorised authorities;
b. filing and handling of complaints;
c. settlement of public law contributions;
3. legitimate legal interest:
a. To document the performance of a transaction;
b. establishing, defending and asserting claims;
c. direct marketing;
d. to produce compilations, analyses and statistics for internal purposes;
e. verification of the counterparty’s creditworthiness;
f. archiving.
3. RECRUITMENT
We are recruiting employees.
Data subjects: job applicants.
Data processed: personal data provided by the recruit or the recruitment company, such as name, date of birth, contact details, correspondence details, educational data, previous employment history, professional entitlements.
Personal data as part of the recruitment process are obtained on the basis of the consent given. The person who has given consent has the right to withdraw consent at any time without affecting the legality of previous processing.
Basis and purposes of data processing:
1) consent;
2) conclusion and performance of a contract;
3) performance of existing legal obligations, e.g:
a. storage of data for future proceedings of authorised authorities;
b. settlement of public law contributions;
4) legitimate legal interest:
a. Recruitment;
b. establishment, defence and enforcement of claims;
c. compilation of summaries, analyses and statistics for internal purposes;
d. archiving (for a maximum period of 3 months).
4. THE RUNNING OF THE COMPANY
We process personal data as part of the day-to-day running of the company.
Data subjects: entities who contact the company, as well as their employees and their associates, persons on our premises and in the buildings
in connection with video surveillance.
Data processed: Name of the person, service data, contact data, address data, registration and record data, registration numbers of vehicles entering the company’s premises in accordance with applicable regulations, as well as video surveillance images (up to 14 days). In the event of a breach of the company’s security, the video surveillance image is stored for possible proceedings by public administration authorities.
Basis and purposes of data processing:
1) conclusion and performance of the contract;
2) performance of existing legal obligations, e.g:
a. storage of data for future proceedings of authorised authorities;
b. filing and processing of complaints;
c. settlement of public and legal taxes;
d. investor relations;
3. legitimate legal interest:
a. Documentation of activities;
b. establishment, defence and enforcement of claims;
c. direct marketing;
d. creation of compilations, analyses and statistics for internal purposes;
e. verification of the counterparty’s creditworthiness;
f. archiving;
g. prevention and detection of crime (we care about security).

III.                ORIGIN OF PERSONAL DATA
The personal data processed is provided to us directly by the data subjects or from publicly available sources.

IV.                NO OBLIGATION TO PROVIDE DATA
The provision of personal data is in principle voluntary, however, it may constitute a condition for the conclusion of a contract.

V.                 RECIPIENTS OF PERSONAL DATA
We may transfer the personal data processed, including by authorised persons, to:
1) to entities that process data on our behalf :
(a) entities intermediating in the transactions we conclude;
b) subcontractors;
c) entities providing advisory, consultancy, auditing, IT, legal, tax, accounting assistance, research agencies acting on our behalf;
2) other data controllers processing the data on their own behalf whose participation is necessary for the relevant process, including but not limited to:
(a) other parties to the transaction;
(b) transport companies;
c) freight forwarders;
(d) customs agencies;
e) insurers;
(f) State or local government authorities and agencies;
(g) courts
(h) bailiffs
(i) economic information bureaux
j) postal and courier operators;
k) banks;
l) entities that cooperate with us in handling accounting, tax, legal, health and safety matters, to the extent that they become data controllers;

VI.                DATA RETENTION PERIOD
We process the data for the time necessary to achieve the purpose of the processing. Once it is completed, we archive the personal data in accordance with the applicable legal provisions. Due to the statutory limitation periods for civil law claims and the limitation period for public law claims, personal data are deleted after 10 years counting from the end of the year in which the purpose of the processing was achieved.

VII.              OBJECTION TO DIRECT MARKETING
The person whose personal data is processed for direct marketing purposes has the right to object to the processing of his/her data for marketing purposes, which he/she may submit to the following email address: [email protected] or by letter to the address below.

VIII.            AUTOMATED DECISION-MAKING
We do not make decisions that are based solely on automated processing, including profiling, of personal data.

IX.                 TRANSFER OF PERSONAL DATA OUTSIDE THE EEA
If we need to enter into a transaction with a counterparty outside the EEA, we may need to transfer personal data outside the EEA. We may transfer data of drivers or employees of the entities involved in the transaction. As a general rule, the transfer of data outside the EEA will take place on the basis of standard contractual clauses, the content of which has been approved by the European Commission.

X.                   RIGHTS OF DATA SUBJECTS
Data subjects have the right to:
1) rectification (correction) of data, to the extent and in accordance with the principles set out in Article 16 of the RODO;
2) erasure of data, to the extent and on the terms set out in Article 17 RODO;
3) restriction of processing (withholding of operations on the data or not deleting the data – according to the submitted request), within the scope and on the principles set out in Article 18 RODO;
4) access to the data (by requesting information about the data we process and a copy of the data), to the extent and in accordance with the principles set out in Article 15 RODO;
5) data portability, to the extent and in accordance with the principles set out in Article 20 RODO;
6) to object to our processing of your personal data (including profiling) where the use of your data is based on our legitimate interests, to the extent and in accordance with the principles set out in Article 21 RODO.

In order to protect the data from unauthorised access, we may request additional identification of the data subject or additional information. The possibility of exercising each of the above-mentioned rights results from the applicable legal provisions, e.g. depends on the legal basis for the processing of the data and on the purpose of the processing.

XI.                 COMPLAINT TO THE SUPERVISORY AUTHORITY
The data subject has the right to lodge a complaint with the supervisory authority regarding the processing of his/her personal data as indicated at www.giodo.gov.pl.
